Terms of Service

These Terms of Service govern your use of 9by16 at 9by16.co ("the Service"), operated by 9by16 ("we", "us", "our"). By accessing or using the Service you agree to these terms. If you do not agree, do not use the Service.
1. What the Service is
9by16 is a curated library of short-form video and social media posts, organised by tag. Anyone can browse the library. To submit posts, create collections, and follow creators, you must register a free account. The Service allows registered users to browse saved posts, submit posts for review, create and share collections, and follow other users. Administrators moderate submissions and manage the platform.
2. Eligibility and access
You must be at least 13 years old to register an account. You may browse the library without an account. To submit content, create collections, or follow other users you must register and maintain a valid account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Access may be suspended or revoked at any time at our discretion.
3. Submitting content
When you submit a post via the website or via Instagram Direct Message, you confirm that:
- You have the right to submit the post for inclusion in the library
- The post does not infringe any third party's intellectual property or privacy rights
- The post does not contain unlawful, harmful, or offensive content
All submissions are subject to admin review before appearing in the library. We reserve the right to reject or remove any submission without notice or explanation.
4. Intellectual property
The posts displayed in the library are the property of their respective creators. 9by16 does not claim ownership of any submitted content. The 9by16 name, logo, and interface design are our property and may not be reproduced without permission.
5. Prohibited conduct
You must not:
- Attempt to gain unauthorised access to any part of the Service
- Scrape, crawl, or systematically extract data from the Service
- Share your account credentials or allow others to access your account
- Use the Service in any way that violates applicable law or Meta's Platform Terms
- Submit spam, misleading content, or content that infringes third-party rights
6. Paid plans
Some features require a paid plan. Prices are shown in pounds sterling on our pricing page and are charged in advance through Stripe, who process payments on our behalf and hold your card details. We do not store card numbers.
Plans renew automatically at the end of each billing period — monthly or annual, whichever you chose — at the price then shown for your plan, until you cancel. We will tell you before any price change takes effect, and a change only ever applies from your next renewal.
You can cancel at any time from your billing settings. Cancellation takes effect at the end of the period you have already paid for: you keep full access until that date, and we do not refund the unused part of a period. Annual plans therefore run to the end of the year you paid for rather than being refunded in part.
If you are a consumer in the UK or EU, this does not affect your statutory right to cancel within 14 days of first subscribing. Where you have asked us to start the service immediately, we may charge for what you have used up to the point you cancel, and refund the balance.
Team plans are billed per seat. Adding seats mid-term is charged pro rata for the remainder of the period; removing seats reduces the cost from your next renewal. Whoever set the team up is responsible for its bill.
If a payment fails and is not resolved, the account returns to the free plan. Your saved references and collections remain, but features limited to paid plans stop being available. Free access granted to students, or under any other concession, is given at our discretion and may be withdrawn.
7. Availability and changes
We make no guarantee of uptime or continued availability. We may change, suspend, or discontinue the Service at any time without notice. We may update these terms at any time; the date at the top reflects the latest revision. Continued use of the Service constitutes acceptance.
8. Disclaimer and limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.
If you are a consumer, you have statutory rights under the Consumer Rights Act 2015 — including that a service is carried out with reasonable care and skill, and that digital content is of satisfactory quality, fit for purpose and as described. Nothing in these terms affects those rights, and where anything here conflicts with them, your statutory rights prevail.
Subject to the above, the Service is provided as it is and we give no other warranties. We are not liable for loss that was not reasonably foreseeable when you started using the Service, and if you are using it for business purposes we are not liable for lost profits, lost business or lost data. Where we are liable, our total liability for all claims in any twelve-month period is limited to the greater of the amount you paid us in that period and £100.
9. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings in your local courts. If you live in Scotland or Northern Ireland, you may also bring proceedings there.
If something has gone wrong, email us first — we would rather sort it out directly than have you take it anywhere else.
